The Law Firm of Kaiser & Swindells was founded in 1981. At that time we were principally engaged in insurance defense work. The Farmers Insurance Group of Companies and State Farm Insurance were our primary clients. Through the years that followed, we drew complex cases concerning a wide spectrum of personal, professional and commercial liability issues. Our firm refined its protocol in handling personal injury lawsuits. Raymond T. Kaiser had been a pre-med at the University of Southern California, majoring in physiological psychology. After graduating from Loyola Law School, his early days in law at Buck, Molony, Nimmo & Ammirato were spent representing medical care providers and insureds of professional and commercial carriers. Pamela A. Swindells, our other partner, had been a registered nurse at Long Beach Community Hospital before entering the field of law. Ms. Swindells' aptitude for medical sciences gave her exceptional insight when analyzing the propriety of medical care or the legal cause of bodily injury. The breadth of our legal service increased as Kaiser & Swindells enlarged its client base to include trucking companies, public transportation carriers, building contractors, property owners, medical and dental providers, shipping and maritime operations, homeowner associations and realtors. |

Bodily injury litigation work necessarily lead to business and commercial dispute resolution. Tort or personal injury matters often involve contract indemnity provisions or other contractual relationships between the parties. Business litigation then blossomed. The Law Firm of Kaiser & Swindells protected its business accounts from unfair competition, contract breaches and business torts. We discovered that traditional "business litigators" failed to embrace the prospects of a jury trial with as much enthusiasm as traditional "tort litigators." Our rather conservative insurance based legal fees also were exceedingly attractive to our business accounts. |

As we developed closer and closer ties to our business clients, we were asked for our advice before litigation arose. Consequently, our practice once again expanded to include business entity formation, employer-employee relations, contract negotiation, contract formation and licensing agreements. Both Ray and Pam have acted as legal counsel to the Long Beach City, Civil Service Commission. Our law firm's real estate litigation experience came to the attention of homeowner associations, facing unique problems. Our representation of condominium homeowner associations and other Common Interest Developments soon evolved to include disputes over governing documents, rule enforcement and assessments. Because the Law Firm of Kaiser & Swindells has served clients for over 20 years, we have had the opportunity to pragmatically test the accuracy of our legal opinions and advice. We offer clients complete legal representation; from forming a business or contract, through the trial of a tort or contract action, concluding with appellate work if necessary. It is extremely unusual to find a boutique firm with the in-house expertise to finish what it has started. |

Our appellate work requires detailed consideration of both facts and law. Kaiser & Swindells has had its appellate work certified for publication because we have been at the cutting edge of the law. The attorneys on staff have a remarkable track record of success. We have had abundant favorable jury verdicts in complex cases and a $50 Million special verdict to right an unjustified wrong. That is not to say, of course, that we have never been met with failure. The practice of law intrinsically involves risk. It is our job, however, to minimize the legal risks for our clients and to secure an advantageous outcome. Few established law firms are able to represent, as we can say, that our attorneys have never been presented with a claim of our alleged legal malpractice. The partners have no reluctance "to go to war" although self insured institutions and other businesses often look at the big picture when a legal dispute arises. We always desire to be cost effective and this may mean participating in Alternative Dispute Resolution, such as mediation or arbitration. Raymond T. Kaiser has served as an arbitrator for the American Arbitration Association, for the Los Angeles County Court Settlement Program and for the Office of Independent Counsel, concerning Kaiser Permanente medical malpractice claims. Pamela A. Swindells has also served as a voluntary settlement officer. Both partners currently act as legal fee arbitrators for the local Long Beach Bar Fee Dispute Resolution Program. Our firm also acts as special counsel to the Long Beach City Attorney with respect to Pitchess motions. |

Our law firm does not profess to represent only defendants (people who are sued) over plaintiffs (people who are claiming damage or injury).
